1. SCOPE OF POLICY: Oud Avenue (“Oud Avenue” or “we” or “us”) cares about your online privacy. This Privacy Policy (the “Policy”) describes our practices with respect to the collection, use, disclosure, protection, etc., of your information when you use oudavenue.com (the “Platform”) or purchase our products through it (the “Services”).

If you create an account, submit personal information, or use the Services, that signifies your legal acceptance of the Policy. Your acceptance of the Policy will be confirmed where you tick a consent box or take other actions that depict acceptance. You must exit the Platform if you do not agree with any provisions of the Policy.

2. COLLECTION OF INFORMATION: We will collect the below categories of information when you access the Platform or use the Services. This information may be classified under personal information or non-personal information. This information may be collected by us where you submit them; where we collect them automatically; or where we collect them from third parties:

 

Information you submit to us

We collect the information you submit in forms provided on the Platform. These forms may include, without limitation, the account sign-up form, shipping information form, payment information form, review form, email newsletter sign-up form, and other information you submit on the checkout page. The information you may submit in these forms may include, without limitation, your name, email address, phone number, country information (city, zip code, state, city, etc.), and payment method.

Information we collect automatically

When you access the Platform or interact with the Services, we collect certain information automatically. This information may include, without limitation, (i) your device browser information, including the browser type, operating system, and IP address; (ii) analytics and usage information, including the URL that referred you to the Platform, your duration of use, the features you click, the items you view, the actions you take, your duration of stay, etc.; (iii) your geolocation; and (iv) the details of your transactions, including the item bought, amount paid, and other order information. We collect information automatically using cookies and third-party tracking tool, Google Analytics. Also, this information is collected on our behalf by Shopify Inc. (“Shopify”), being the third-party service provider that powers and help us host the Platform. The information we receive from third parties

We may also receive information about you from third parties. For example, if you signup or sign in to place an order using any of the social media plugins (such as Facebook, Twitter, Amazon, and Google) available on the Platform, we will automatically obtain your profile information – subject to your permission settings – from the applicable social platform.

 

3. USE OF INFORMATION: We use the collected information for the following purposes:
  • To provide the Services and/or information that you have asked for;
  • To communicate with you regarding your requests, questions, and complaints;
  • To process your order payments and ship them to you based on your shipping address;
  • To communicate with you about your orders and your account;
  • To notify you about changes to this Policy, other agreements, and other administrative messages;
  • To send you messages about products or offers that we think may be of interest to you;
  • To monitor violations of our Terms of Service, enforce our rights, carry out our obligations, prevent fraud, and respond to government requests;
  • To gather analytics about how you use the Platform and provide improvements for a better user experience;
  • To accomplish any other purpose for which the information was provided.

4. COOKIES AND TRACKING TOOLS: Like other platforms, Oud Avenue and third-party service providers use cookies and Google Analytics on the Platform.

Cookies

Cookies are tiny pieces of data website owners attach to your device browser to obtain certain choices and preferences about you and perform other actions.

The cookies available on the Platform are set by Shopify on our behalf. Certain third parties, such as Facebook and other social apps, set their own cookies too.

We use cookies to: (i) improve your user experience while you access and shop with us; (ii) to remember your device, your inputs, login information, and items you save in cart; (iii) secure the Platform from fraudulent activities and unauthorized uses; (iv) display the Platform and its content; and (v) gather analytics and usage information.

Cookies are of two durations: They can last for a browsing session or stay for defined periods. Cookies that expire after a browsing session are called “session cookies,” while cookies that stay for longer than a browsing session are called “permanent cookies.”

You have the right to remove, delete, or block cookies from your browser. This can be done via the setting, edit, or tools of your device browser. Please, be aware that removing, deleting, or blocking cookies may render some features unavailable to you. For example, if you remove the session cookie, you may need to always manually provide your login details when you come back to the Platform.

Google Analytics

Google Analytics is a third-party tracking tool developed by Google Inc. We use this tool mainly to gather analytics about how users use the Platform (as described under Collection of Information above). You may opt out of Google Analytics from tracking your use of the Platform by installing a Google Analytics Opt-Out add-on your browser. To learn more about Google Analytics, click here.

5. DISCLOSURE OF INFORMATION: In addition to sharing your information as described above, we may disclose the collected personal information as follows:

  • In the event there is a sale, merger, acquisition, or other transfer in the ownership of the Platform or our business, the successor will receive personal information about the Platform users along with the assets transferred.
  • We will disclose personal information to our contractors, business partners, third-party service providers, and other entities or individuals who provide support for the Platform (for example, our integration, API, shipping, and payment processing partners).
  • Aggregated, anonymized information that does not identify any particular user can be disclosed without restriction.
  • We will disclose personal information in response to a court order, regulatory request or legal process from applicable law enforcement agencies.
  • If we decide that the disclosure is appropriate to protect the property, safety, rights of the Platform, its users, or a third party.
  • Where you submit user-generated content (such as reviews) to public areas of the Platform, personal information attached to such user-generated content will be publicly available to other users and visitors.
6. INFORMATION SECURITY: Only our administrators are allowed to access the Platform’s password-protected server where your personal information is stored. We utilize SSL Encryption for all information transmitted to and from the Platform. We do not store your card details on our database. Your payment is handled by our third-party payment processors (Shopify and PayPal). However, any transmission of information over the Internet has its inherent risks. Therefore, we cannot guarantee the absolute security of your personal information. We shall not be liable for circumvention of security measures or privacy settings on the Platform.

 

7. MARKETING EMAILS: We may send occasional marketing emails about products and offers we think may match your interest to your email address. Marketing emails will only be sent to you if you subscribe to our marketing list. Subscription can be done by submitting your email address in the newsletter form at the website footer or when you tick the “keep me up to date on news and offers” on the checkout page. However, you have the right to opt out of marketing emails any time by using the “unsubscribe” link at the bottom of any email we send to you.

 

8. CHILDREN’S PRIVACY: We do not knowingly collect any personal information about children under the age of 18. The Platform is not directed or targeted to children under the age of 18. If we become aware that a child under 18 has provided any personal information, it will be erased from our database as soon as reasonably possible, except when we need to keep that information for legal purposes or to notify a parent or guardian. However, portions of this information may remain in backup archives or weblogs even after erasing it from our databases. 9. ACCESSING AND CORRECTING YOUR INFORMATION: You can view and edit some of your account information (including your payment method and shipping information) when you log in to your account. You may also request the deletion of your information and user account. If you terminate your account, we may retain some information for as long as necessary to evaluate the Platform usage, troubleshoot issues, resolve disputes, and collect any fees owed. If you have any questions or wish to delete any of your personal information or user account, please send us an e-mail to Info@oudavenue.com. Note that we can deny your request if we think it would violate any law or cause the information to be incorrect.

 

10. EU USERS’ RIGHTS: This section applies to the users of the Platform in the EU and countries under the General Data Protection Regulation (“GDPR”). The GDPR provides you with additional rights to the rights above.
  • The right to be informed, to access, rectify, erase, or restrict the processing of personal information. You have the right to obtain free information about what personal information we have obtained about you, where it is stored, for how long, for what purposes it is used, and to whom it was disclosed. You have the right to have us, without undue delay, rectify inaccurate personal information concerning you. That means you can request that we change your information in our records, or have your incomplete information completed. You have the “right to be forgotten,” i.e., to have us delete your information, without undue delay, if the information is no longer necessary in relation to the purposes for which it was collected. However, GDPR gives us the right to refuse erasure if we can demonstrate compelling legitimate grounds for keeping your information.
  • The right to restrict the processing of certain information. This right applies if any of the following applies:
  1. If you contest the accuracy of your information, we will restrict processing it for a period enabling us to verify its accuracy.
  2. The processing is unlawful, and you oppose its erasure and request instead the restriction of its use.
  3. We no longer need your information for the purposes of the processing, but you require us to restrict processing for the establishment, exercise, or defense of legal claims.
  4. You have objected to processing pursuant to Article 21(1) of the GDPR pending the verification whether our legitimate grounds override yours.
    • The right to withdraw your consent. The GDPR grants you the right to withdraw your earlier given consent, if any, to processing your information at any time.
    • The right to data portability. Upon request, we will provide you your information in our possession, in a structured, commonly used, and machine-readable format. You have the right to transmit that data to another controller if doing so does not adversely affect the rights and freedoms of others.
    • The right to object processing. You can object, on grounds relating your particular situation, at any time, to processing of your information, if based on point (e) or (f) of Article 6(1) of the GDPR.  We will then have to stop processing, unless we can demonstrate compelling legitimate grounds for the processing. If you object to the processing for direct marketing purposes, we will have to stop processing for these purposes.
    11. CALIFORNIA USERS’ RIGHTS; CCPA: We will not share your information with third parties for their direct marketing purposes to the extent it is forbidden by law. If our practices change, we will do so in accordance with applicable laws and will notify you in advance. Your rights under the California Consumer Privacy Act (“CCPA”) includes:
    • You can request access to the categories of information we shared about you to third parties in the past 12 calendar months by writing to us at Info@oudavenue.com. We will then provide the requested information, its sources, and purposes of use in a portable and easily accessible format within 45 days of the request.
    • You have the right to request the deletion of your information from our systems by submitting a request to us via Info@oudavenue.com.
    • You have the right to nondiscrimination for exercising your rights. This means that you cannot be denied the Services, charged different prices, or provided different quality of goods/services for asserting your legal rights.

    12. NOTICE TO NEVADA USERS: The Nevada law permits users who are residents in Nevada to opt out of the future sale of their information between third parties. This means that, even though we do not engage in the sale of personal information at this moment, Nevada users can opt out now if we decide to engage in this practice in the future. This applies only to Nevada users who have purchased from us. Please, send in your request to us at Info@oudavenue.com. We may verify you if you attempt to exercise this right.

    13. INTERNATIONAL TRANSFER OF INFORMATION: If you are transferring personal information to us, be aware that we will process it in the United States, our location of operation. Likewise, we may transfer your information to third-party service providers in other locations outside of the United States and the location in which you provided the information. However, when we transfer information to third parties, we will ensure it is protected in accordance with this Policy.

    If you provided us personal information from the EU or similar countries under the GDPR, we will only transfer personal information about you using the approved data transfer mechanism by the European Commission.

    14. INFORMATION RETENTION: Unless you request to exercise your right to delete your information, we will retain your information with us until the purpose for which we collected it is achieved. However, we may retain certain information (such as transaction details) with us for longer periods in compliance with our legal obligation to keep records.

    15. THIRD-PARTY NETWORKS: Note that this Policy applies only to the information we collect via the Platform and Services. It does not apply to any third-party networks or services, even if they are referenced on the Platform. Any and all third-party networks have their separate policies. You should review them before accessing their networks.

    16. CHANGES TO THIS POLICY: We reserve the right to change this Policy at any time at our sole discretion. The effective date of the last update is at the top of this page, so visit it occasionally to see if there are any changes.
